CANCELLATION BY CHARTERER:

• If a Charterer cancels before the Charter Period, amounts paid are retained.

• Owner and Broker will try to rebook. Refund, if the new charter is secured, minus 20% fee and incurred expenses.

• No refund if a new charter isn't booked despite efforts.

CANCELLATION BY OWNER:

• If Owner cancels for reasons other than Force Majeure, full reimbursement to the Charterer.

• Owner pays commissions to Broker and fees to Stakeholder.

YACHT DELIVERY:

• Owner ensures Yacht readiness at boarding.

• Yacht delivered fully equipped as agreed.

• No guaranteed comfort in adverse weather.

FORCE MAJEURE:

• Force Majeure events defined.

• Lightning strike exception with full refund.

• Agreement persists; parties' rights maintained.

DELAY IN DELIVERY/FAILURE TO DELIVER:

• Compensation for Force Majeure delays.

• Charterer's right to treat agreement as repudiated.

• Notice requirements for Force Majeure events.

BREAKDOWN/DISABLEMENT:

• Charterers can terminate on Yacht breakdown.

• Refund to charterer; full commissions paid.

• Captain's absolute authority; breaches may lead to termination.

CAPTAIN'S AUTHORITY:

• Captain has full command for safety.

• Termination for breaches after warnings.

• Charterer bears travel expenses upon termination.

RESTRICTED USE:

• No assignment or sub charter without consent.

• Yacht for pleasure only; no illegal activities.

• The Charterer indemnifies the owner for unlawful acts.

NAVIGATION LIMITS:

• Charterer restricts cruising to designated areas.

• Compliance with local laws and regulations required.

INSURANCE AND LIABILITY:

• Owner maintains full insurance coverage.

• Charterer not liable if loss covered by insurance.

• Each party is responsible for their own negligence.

DRUGS AND OTHER ILLEGAL ACTIVITIES:

• Zero-tolerance for illegal activities.

• Termination for breaches; no refund.

• Charterer liable for losses due to violations.

REDELIVERY:

• Charterer redelivers Yacht in the same condition.

• Damages repaired to as-new standard.

• Demurrage for delayed redelivery.

LIENS:

• Charterer ensures no creation of Maritime Liens.

• Indemnification for charges due to breach.
