CHARTER FEE:
• Inclusive Elements: Charter fee includes the hire of the yacht and its equipment, crew wages and yacht insurance.
• Exclusive Elements: Fuel, berthing dues and other harbor charges, including customs formalities, water and electricity taken from shore, ship’s agents’ fees, local taxes, and VAT if applicable, provisioning, and personal laundry.
PAYMENT POLICY:
• Booking Deposit: Typically, 50% of the charter fee is payable upon signing the agreement.
• Final Payment: The remaining 50% of the charter fee plus the APA and any delivery/redelivery fees are due one month before the charter starts.
APA (Advance Provisioning Allowance):
APA is typically 25-35% of the charter fee. It covers the costs of fuel, food, drinks, and other operational expenses during the charter. The captain manages the APA and provides an account of the expenditures.
CANCELLATION POLICY:
• Charterer’s Cancellation: Refunds depend on the timing of the cancellation. The closer to the charter date, the smaller the refund.
• Owner’s Cancellation: If the owner cancels, the charterer is typically refunded in full or offered an alternative yacht of similar or higher standard.
INSURANCE:
The yacht is insured by the owner for marine risk, third-party claims, and crew liability. Charterers are recommended to obtain personal travel insurance for additional protection.
CREW & RESPONSIBILITIES:
The crew is responsible for operating the yacht, maintaining it, and providing services to the charterer as per industry standards.
CHARTERER’S OBLIGATIONS:
Charterers must comply with all local laws and respect the yacht and crew. Illegal activities are strictly prohibited.
LIABILITY AND INDEMNITY:
Details the liabilities of both parties in case of damage or loss and includes indemnity clauses to protect against certain claims.
FORCE MAJEURE:
Specifies conditions under which the charter agreement can be voided due to unforeseen events like natural disasters or political instability.
DISPUTE RESOLUTION:
Usually, disputes are resolved through arbitration to ensure a fair and efficient process.
USE OF THE YACHT:
Specifies where the yacht can sail and any geographical or activity restrictions.
DELIVERY AND REDELIVERY:
Outlines the terms regarding the start and end of the charter, including locations and timing for embarkation and disembarkation.
DAMAGE AND LOSS:
Specifies the charterer’s responsibility for any damages or losses to the yacht or its equipment during the charter period.
